Elefanty is operated by:

References to "Elefanty", "we", "us", and "our" refer to this operator. References to "you" and "user" refer to the individual or entity using the Platform.

By creating an account, submitting a Creation, purchasing a service, or otherwise using Elefanty, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these Terms, you may not access or use the Platform.

We may revise these Terms from time to time. Material changes will be communicated through the Platform or by email where appropriate. Your continued use of Elefanty after a material change has been communicated constitutes acceptance of the updated Terms, but we will not rely solely on continued use to infer consent to changes that significantly alter your rights or obligations without appropriate notice.

Elefanty allows users to record and securely store creations and related materials and creates a timestamped platform record showing that particular content was associated with a user account at a particular time. Elefanty may also provide optional AI-powered tools for developing and analysing submitted creations.

Elefanty does NOT:

• register intellectual property
• grant copyright, patents, or trademarks
• establish legal ownership
• determine originality or novelty
• act as a notary or government IP registry
• provide legal advice

A timestamp, UID, reference number, or other record generated by Elefanty records that specified content was associated with an Elefanty account at a particular time.

It does not independently prove:

• authorship or legal ownership
• originality, novelty, or priority
• confidentiality or patentability
• copyright or trademark protection
• enforceability of intellectual property rights

It is not:

• notarisation or government registration
• patent filing or copyright registration
• trademark registration
• qualified legal advice

Users requiring formal intellectual-property protection should seek appropriate professional advice.

As between you and Elefanty, you retain any rights you lawfully hold in the content you submit. Elefanty does not claim ownership of your Creations, does not verify who legally owns submitted material, does not determine whether submitted material is original, and does not resolve competing ownership claims.

You represent that you have sufficient rights to submit the content and to allow Elefanty to process it as described in these Terms.

You grant Elefanty and its service providers a limited, non-exclusive, worldwide (where technically required) license to host, store, process, transmit, reproduce technically as needed, analyse where AI features are requested, and display where you intentionally select a public feature — only as necessary to provide, secure, maintain, and improve the Platform. This license is not a transfer of ownership.

Elefanty provides privacy controls and uses reasonable technical and security measures to protect your content. Private Creations are intended to be accessible only according to the Platform's access controls and authorised operational access.

However, Elefanty does not promise absolute confidentiality, does not guarantee that no authorised infrastructure or service provider will ever technically process the content, and is not end-to-end encrypted unless explicitly stated for a specific feature.

If formal NDA or trade-secret controls are necessary for your situation, do not rely on Elefanty as your sole confidentiality mechanism.

Where Elefanty makes public, anonymous, marketplace, or sharing functionality available, selecting a public option means your content may become visible to others. You are responsible for selecting the appropriate privacy level for each Creation.

Marketplace and collaboration features may be offered in the future but are not currently live. Do not rely on these features being available until they are officially announced.

You agree to:

• use Elefanty lawfully and in accordance with these Terms
• provide accurate account information and keep it current
• maintain the security of your account credentials
• only submit content you have sufficient rights to submit
• maintain independent backups of important content
• comply with applicable law
• not upload malware or harmful code
• not access or attempt to access another user's data
• not circumvent quotas, payment controls, or entitlement limits
• not abuse APIs, AI resources, or automated systems
• not scrape or engage in automated abuse of the Platform
• not impersonate others or misrepresent your identity

You may not submit content that:

• violates applicable law
• infringes third-party intellectual property rights
• violates privacy or confidentiality rights
• contains malware or harmful code
• is fraudulent or deceptive
• is abusive, harmful, or threatening
• is submitted without the necessary rights

Elefanty may remove or restrict content where reasonably necessary for legal, security, or platform-protection reasons.

AI-generated outputs may be inaccurate, incomplete, contain errors, be non-unique, resemble content generated for others, reflect model limitations, or become outdated. AI scores are indicative assessments, not objective facts.

AI output does NOT constitute:

• legal advice
• patentability analysis or novelty search
• freedom-to-operate analysis
• financial or investment advice
• professional market research
• guaranteed commercial validation

You must independently verify AI output before relying on it. Elefanty does not guarantee intellectual-property ownership in AI-generated images or text.

Currently supported pay-per-creation products:

• Single Registration / Evidence Record: $0.99 per new Creation
• AI Enrichment: $1.99 per new Creation

Payments are processed by Stripe. Elefanty does not store full card details. Prices displayed at checkout control the transaction. Payment must complete successfully before paid service fulfillment.

Duplicate or failed transactions should be reported to support. Subscription services may be offered in the future. Workspaces may be described as a future subscription feature but are not currently purchasable.

Except where required by applicable law, fees for successfully delivered digital services are non-refundable.

If you experience a duplicate payment, failed fulfillment, or billing error, please contact support so we can investigate and assist you.

Nothing in these Terms excludes or limits any mandatory consumer rights you may have under applicable law.

Elefanty may offer free Creations, Early Bird access, trials, or other promotional entitlements. Eligibility rules may apply, and promotions may be modified or withdrawn prospectively. Previously completed paid transactions are unaffected by promotional changes.

Abuse of promotional offers may result in removal of promotional eligibility. The current free-creation promotion does not last forever and may be modified or discontinued.

Elefanty relies on third-party service providers, which may include:

• cloud and application infrastructure (Base44)
• payment processors (Stripe)
• AI and model providers
• email and communications services
• hosting and storage providers

Third-party processing is further described in the Privacy Policy. Elefanty is not responsible for outages or failures entirely outside its reasonable control, subject to mandatory law.

Elefanty uses reasonable efforts to maintain security and availability but cannot guarantee uninterrupted service, zero errors, zero security incidents, permanent preservation of all data, compatibility with every device or browser, or that all features remain unchanged.

You should maintain independent copies of important documents and content. This does not contradict the Platform's private-file or security measures — rather, it acknowledges that no online service can guarantee absolute data preservation.

Excluding User Content, Elefanty and/or its licensors own rights in the Elefanty name and branding, logos, software, interface, visual design, documentation, original site content, databases and compilations where protected, and underlying technology.

Users receive only a limited right to use the Platform according to these Terms. Unauthorised copying, resale, reverse engineering, or exploitation of Elefanty's intellectual property is prohibited except where legally permitted.

You may request deletion of your account through the mechanisms provided on the Platform or by contacting us.

Elefanty may suspend or restrict accounts where: Terms are violated, security is threatened, payment fraud occurs, abuse occurs, or where required by law. Where appropriate, Elefanty will provide reasonable notice, unless immediate action is necessary for security or legal reasons.

Elefanty is provided on an "as available" basis. Elefanty does not guarantee commercial success or IP enforceability. To the maximum extent permitted by law, Elefanty shall not be liable for indirect or consequential losses, or for any reliance on AI output or failure to obtain professional IP protection.

Elefanty's aggregate liability shall not exceed the amount actually paid by the user to Elefanty during the 12 months preceding the event giving rise to the claim.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

To the extent legally permitted, you agree to indemnify Elefanty against claims arising from: your unlawful content, your infringement of third-party rights, your misuse of the Platform, or your breach of these Terms.

This indemnity is intended to be reasonable and enforceable and does not apply where it would be unlawful to require it under applicable consumer-protection law.

These Terms are governed by the substantive laws of Switzerland, excluding its conflict-of-law rules.

Subject to mandatory consumer-protection jurisdiction rules, disputes shall be subject to the competent courts at the registered seat of Oliver Kisszabo.

Nothing in these Terms deprives consumers of mandatory rights they may have to bring claims in their place of residence under applicable law.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions remain in full force and effect. Failure by Elefanty to enforce any provision is not a waiver of that provision or any other provision.

These Terms, together with the Privacy Policy and other referenced policies, form the entire agreement between you and Elefanty regarding use of the Platform.
